Last Will and Testament of Alston Andrus

Be it remembered, That heretofore, to wit: on the 14th day of  May in the year of our Lord one thousand eight hundred seventy-seven Frances M. Andrus the Executrix named in the Last Will and Testament of Alston Andrus late of the town of Horseheads in the County of Chemung deceased, appeared before the Surrogate of the County of Chemung and made application to have the said Last Will and Testament, which relates to both Real and Personal Estate, proved:
and on such application the said Surrogate did ascertain by satisfactory evidence who were the widow heirs at law and next of kin of the said testator, and their respective residences, (viz.) Frances M. Andrus widow  Amelia D. Andrus Daughter both of full age and Sylvester H. Andrus a son and Eloise Louisa Andrus a Daughter  infants all residing in the town of Horseheads  Chemung County  and said Surrogate did thereupon issue a Citation in due form of law, directed  to the heirs at law and next of kin by their respective names, stating their respective places of residence, requiring them to appear before said Surrogate at his Office in the City of Elmira in said County on the 28th day of May  A. D. 1877, to attend the Probate of said Will. And afterwards, to wit: on the 28th day of May A. D. 1877, satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law, and on that day, no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth,
upon this 28th day of May A. D. 1877, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament, and proofs are as follows, that is to say:

I Alston Andrus of the town of Horseheads in the County of Chemung and State of New York being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore make ordain publish and declare this to be my Last Will & Testament that is to say,
First After all my lawful debts are paid and discharged I give and bequeath to my beloved wife Francis [sic] Andrus one third of all my real and personal estate:
Second I give and bequeath to George R. Andrus my Nephew Five hundred Dollars when he becomes of the age of twenty one years provided he remains with the family and works on the farm until he is twenty one years of age otherwise this five hundred Dollars shall revert to my lawful heirs
Third I give and bequeath to my three children Amelia D. Andrus Sylvester H. Andrus and Elsie Louisa Andrus. The balance of my Real and Personal Estate to each share and share alike when the youngest child becomes of the age of twenty one years;Likewise I make constitute and appoint Archibald Donald of Horseheads Chemung Co New York to be my Executor and my wife Frances Andrus to be Executrix of this my last will and Testament hereby revoking all former wills by me made [.] In Witness whereof I Have Hereunto Subscribed my name and affixed my seal the Sixteenth day of April in the year of our Lord One thousand Eight Hundred

To T. S. Spaulding Surrogate of the county of Chemung:
The petition of Francis [sic] Andrus of the town of Horseheads in the county of
Chemung respectfully sheweth that your petitioner is the Executrix named in the last will and testament of Alston Andrus late of the town of Horseheads in the county of Chemung deceased. That the said deceased was at or immediately previous to his death, an inhabitant of the county of Chemung, and departed this life in the town of Horseheads on the 2d day of May 1877; and that his s___ will and testament related to both real and personal estate, and that the estate of said deceased both real and personal does not exceed the sum of Fifteen Thousand dollars.
Your petitioner further shews that the heirs and next of kin of the said deceased are:
Amelia D. Andrus a daughter of deceased of full age residing at Horseheads N Y
Sylvester H. Andrus & Elsie Louise Andrus infant children of said deceased both residing in Horseheads N Y and having no General Guardian
That the deceased left your petitioner his widow him surviving. Your petitioner therefore prays that said last will and testament be proved, and letters testamentary be granted thereon according to law.

You, and each of you, are hereby cited and required personally to be and appear before our Surrogate of the County of Chemung, at his office in the City of Elmira, on the 28th day of May 1877 at 10 o'clock in the forenoon of that day, then and there to attend the probate of the last Will and Testament of Alston Andrus late of the town of Horseheads of Chemung and State of New York deceased, which relates to both Real and Personal Estate, and for the Probate whereof Francis [sic] Andrus the Executrix therein named of Horseheads in the County of Chemung has lately applied to our said Surrogate. In Testimony Whereof, We have caused the Seal of Office of said Surrogate to be hereunto affixed.

Item 3: Statement of service of citations to Amelia, Sylvester, and Elsie Andrus

    Archibald Donald of the town of Horseheads in said County being duly sworn says that on the 14th day of May 1877 at the town of Horseheads aforesaid has served the within citation upon Amelia D. Andrus one of the persons therein named by delivery to and leaving with her a copy thereof and at this same time showing her the original with the seal + signature of the Surrogate _____ that on the 13th day of May 1877 at Horseheads aforesaid he served said citation upon Sylvester H. Andrus & Elsie Louise Andrus infants by delivery to and leaving with each a copy  thereof and also by delivery to and leaving with Frances M. Andrus their mother with whom they reside a copy thereof & at the same time showing each such original with such

Item 4: Petition to name A. Donald Guardian of Sylvester and Elsie Andrus

Date: 12 July 1877
In the Matter of the Petition of Sylvester H. Andrus & Elsie Louise Andrus Infants by the Mother & Next Friend
To Hon. Thomas S. Spaulding Surrogate Chemung County
The Petition of said Infants by Frances Andrus their mother & next Friend respectfully shews:
That the said Sylvester H. Andrus is an Infant under the age of fourteen years ___ who will be 14 years in age on the 15th day of January 1878- That the said Elsie Louise Andrus is also an Infant with age of ten years on the 22nd day in July 1876. Said Infants are children of Alston Andrus late of Horseheads Deceased. That by the Will of the said Alston Andrus the said Infants are each entitled to an undivided one third of 2/3 of one hundred + sixty acres of land of the yearly value of $500 [or $1500?] - and the same interest in about $1200 of personal property and which is all the property said Infants heir to. That said Infants have no General Guardian.
Said Petitioner prays that Archibald Donald be appointed Guardian of the Estate of the said Infants.

Item 5: Statement by Frances Andrus & A. Donald they are prepared to render estate
accounting
Date: 30 September 1878
To T. S. Spaulding Surrogate of Chemung County:
The petitions of Francis [sic] M. Andrus Executrix and A. Donald Executor of the last will and testament of Alston Andrus late of the town of Horseheads deceased respectfully shows that twelve months and upwards have expired since their appointment as such Executrix & Executor. Your petitioners further show that in the said last will & testament the said Alston Andrus did dispose of his estate as follows [:] After the payment of his debts one third of his estate real and personal is given to his wife Francis M. Andrus. To his nephew George R. Andrus the sum of $500 when he arrives at the age of 21 years. To his three children viz. Amelia D. Andrus, Sylvester H. Andrus & Elsie L. Andrus the balance of said estate share & share alike when the youngest child attains the age of 21 years. as to the said last will & testament as by the record of the same in the office of the Surrogate references
being ________ will fully appears. And your petitioners pray leave to make such references if it shall be necessary for them so to do for the purposes of a ______ of their accounts as such Executors aforesaid; Your petitioners further show that immediately after their appointment as such Executrix & Executor they entered upon the duties of the trust thereof and that they are prepared to render an account of all their proceedings as such Executrix & Executor aforesaid. They therefore pray
that a citation may ___ out of and under the seal of this court to be directed to all persons interested in the estate of said deceased requiring them to appear in this court on a certain day to be therein specified to attend such settlement of the accounts of your petitioners as such Executrix & Executor as aforesaid.

The daughter Elsie Louise is an infant under the age of fourteen years + has a general guardian the said Archibald Donald. George R. Andrus nephew and legatee. an infant of the age of eighteen years with no general guardian. All of said heirs next of kin and legatees and the said guardian reside in the town of Horseheads in Chemung County.

State of New York, Chemung County
A. Donald of the town of Horseheads in the County of Chemung, in the State of New York, being duly sworn, deposes and says, that he served the annexed Citation on the persons hereinafter named, whom he knows to be the same persons described in and to whom said Citation is directed, by delivery to and leaving with them personally a copy of said Citation, on the day or date, and the place set opposite their respective names, to wit:

Item 8: Accounting of estate
Date: 4 February 1879

In the Matter of the Accounting of Archibald Donald and Frances Andrus as Executor + Executrix of the Last Will and Testament of Alston Andrus Deceased
To the Surrogate of Chemung County:
We Archibald Donald and Frances Andrus of Horseheads in said county do render the following account of our proceedings as executors of Alston Andrus deceased for final settlement and allowance.
On the 28th day of May 1877 Letters Testamentary of the last will and testament of Alston Andrus late of the town of Horseheads in said county deceased were issued to us on the 13th day of July 1877. We caused an inventory of the personal estate of the deceased to be filed. And thereafter and on the 3rd day of February 1879 pursuant to an order of this court granted on the 24th day of December 1878 on our petition for leave to file an amendment or further or supplemental inventory upon the grounds set forth in said section. We caused an amended or further or supplemental inventory of the personal estate of the deceased to be filed which personal estate therein set forth amounts by apprais__ by the appraisers duly appointed to $2518.
Schedule A. hereto annexed contains a statement of all of the property contained in said inventory sold by us at public or private sale with the prices and manner of sale; which sales were fairly made by us at the best prices that could be had with due diligence as we then believed. It also contains a statement of all the debts due the said estate and mentioned all said inventory which have been collected. and also of all items for moneys incurred by us for which the said estate from all sources for which we are accountable. We are legally accountable and all other expenses.
Schedule B. hereto annexed contains a Statement of all debts at said inventory mentioned not collected or collectable; and also a Statement of the articles of personal property mentioned in said inventory unsold and reasons of the same being unsold and their appraised value; and also a statement of all property mentioned therein lost by accident without any willful default or negligence, the cause of its loss and its appraised value. No other assets not herein of any ___ of said account or anything __  herefrom. Which may in anywise prejudice the rights of any party interested in said estate. And deponents further say that the sums under twenty dollars charged in the said account ________________[unreadable] or other
evidences of payment are produced. or for which we may not be able to produce vouchers or other evidences of payment have actually been paid and disbursed by us as charged.

Item 9 : Re Estate accounting by Frances Andrus and A. Donald

We Frances M. Andrus and Archibald Donald of Horseheads in said county being duly sworn that the charges made in the foregoing account of _____s and s______ for moneys paid by us to creditors legatees and next of kin and for necessary expenses ______ that we have been charged _____ all the interest for moneys received by us  _____  ____ said account for which we are legally accountable. That the moneys stated in said account as collected _____ that ____ c_____  c____ according to the best of our knowledge  [unreadable 4 or  5 words]  debts states in such account at the time of the settlement thereof. Item 10: Guardian's inventory

In the Matter of the Guardianship of Elsie Louise Andrus + Sylvester H. Andrus Infants
A just and true inventory of the whole real and personal property estate of the above named infants committed to the care of Archibald Donald Esq. of the village of Horseheads New York their general guardian showing the manner in which the funds are invested, the condition of the property and the condition of the property and the income thereof, etc etc . A to the interest of said Infants in the property and estate of Alston Andrus, their father now deceased reference is made to the last Will and Testament of said Alston Andrus duly admitted to probate and recorded in the Surrogates office of Chemung County - in Vol. 9 of Wills Page 451 - on the 28th
day of May 1877. After paying the lawful debts of said Alston Andrus deceased
the following property remained [part obliterated] one hundred and seventy acres of land situated in the Town of Horseheads, Chemung County New York estimated to be worth about $40 per acre $6800. This farm is occupied by Frances Andrus the widow of said Dec'd and the aforesaid Infant wards under an agreement made by me with her that she shall support, maintain + educate said Infant wards for the avails of their interests in said farm and the personal property. This lease expires April first 1880 + under it said Francis [sic] Andrus has the use of all of the personal property thereon. The following is all the personal property which came into my hands as such Guardian.

Item 12: Request for change in guardian of Sylvester and Elsie Andrus from A. Donald to mother, Frances M. Kies
Date(s): 6 and 17 May 1881
To Hon. Seymour Dexter
Surrogate of Chemung County
The petition of Sylvester H. Andrus and Elsie Louise Andrus respectfully shows:
That the said Sylvester H. is a minor of the age 16 years and upwards that said Elsie Louise is a minor of the age of 14 years and upwards
That they are children of Alston Andrus deceased late of the town of Horseheads. That each of said minors reside in the county of Chemung
That your petitioners are entitled certain real and personal estate in accordance with the provisions of the last will + testament of Alston Andrus their father which will was duly proved and recorded in the office of the Surrogate of the County of Chemung on or about the 28th day of May 1877
That to protect and preserve the legal rights of your petitioners it is necessary that ___ proper person should be appointed the guardian of their persons and estate during their minority
That on or about the 13th day of July 1877 Archibald Donald of Horseheads was duly appointed such guardian. That said Donald is desirous of being relieved of the duties of such trust. Your petitioners therefore nominate subject to the approbation of the surrogate Frances M. Kies of the town of Horseheads in said county to __ch guardian in the place of said Donald and pray her appointment accordingly pursuant to the estate in such case provided.

To the Surrogate of the County of Chemung
The petition of Archibald Donald of said county shows that on the 13th day of July 1877 he was duly appointed General Guardian of the estate __y of Sylvester H. Andrus then aged 13 years on the 15th day of January 1877 and Elsie L. Andrus then aged 10 years on the 22 day of July 1877 until they should respectively attain the age of 14 yrs or until another Guardian should be appointed as will appear by Letters of Guardianship recorded in the office of said Surrogate in Book No. 3 Records of Guardianship pg. 96 on the said 13th day of July 1877. That your petitioner qualified and entered the discharge of his duties as such Guardian . That the mother of said Minors is alive and that said minors have resided + still reside with their said mother on the farm owned by Alston Andrus deceased their father. That said minors are as your petitioner is informed now of the age that allows them to select their guardian subject to the approval of said Surrogate. That the mother of said minors consents to be appointed guardian of said and that your petitioner is desirous of being relieved of said trust upon the grounds that his own personal affairs require his undivided attention and as it appears by the petition of said minors they desire the appointment of their mother Francis [sic] M. Kies as such guardian. Believing thereupon that it would for the best interests of all parties concerned your petitioner prays that he
may be discharged from such trust. That he is now ready to render an accounting of all matters pertaining to his trust.

In the matter of the accounting of Archibald Donald as Guardian of Sylvester H. Andrus and Elsie L. Andrus Minors
To the Surrogate of Chemung County
I Archibald Donald of the town of Horseheads in said county of Chemung do render the following account of my proceedings as General Guardian of Sylvester H. Andrus and Elsie L. Andrus Minors for final settlement and account.
On the 13th day of July 1877 Letters of Guardianship appointing me Guardian of the above named minors by the Surrogate of the county of Chemung as will appear by the records of said Surrogate.
That immediately thereafter I entered upon the duties of such trust.
That the following is a first and true inventory of all the real and personal estate and effects of the said minors which have come into my hands and that is now in my hands and that is now in my hands as such Guardian except as hereafter noted.
That by an agreement entered  with by said Guardian with Francis [sic] M. Kies mother of said Minors. The __s ____ of said interest of said minors is owed real and personal estate as herein noted has been appropriated to the support, maintenance and education of said minors said Francis M. agreeing to __ support + maintain said minors in consideration of such use.
