Last Will and Testament of Moses Wallace

Dec 29, 1775 to Nov 28, 1843

Recorded November 10, 1843 (18 days prior to his death on Nov 28, 1843)

Lewis E. Wallace, and J. LeRoy Wallace)

The Last Will and Testament of Moses Wallace of the town of Chemung in the County of Chemung and State of New York.

In the name of God Amen, I, Moses Wallace being weak in Body but of sound mind and meaning do make and declare this to be my last will and testament in manner and found following to wit:

First, I do will order and direct that all my just debts and funeral charges be paid by my son Moses W. Wallace out of the property of by me hereafter …….. unto him.

Secondly, I do give bequest to my said son Moses W. Wallace and to his heirs and of signs forever all ……the farm on which I now reside situated in the said town of Chemung containing about one hundred and thirty-two acres of land bounded southerly by the Chemung River, eastwardly by Jacob Berdelmans land, Northerly by lands unknown and westwardly by John G. McDowells farm with the opportunities to have and hold the said farm with the opportunities to him the said Moses W. Wallace and his heirs and ….forever subject however to the payment of my debts and funeral charges and also subject to the payment of the …. After mentioned all of which I do hereby order and declare to be charged from my real estate.

Thirdly, I do give and bequest to the children of my deceased son Joseph Wallace ( born Oct 14, 1880 ) , the sum of three hundred dollars to be divided between them …… following to wit to Moses M. Wallace one of the said children two hundred dollars. The remaining one hundred dollars to be divided equally between the others to be paid to them as they shall respectively arrive at the age of twenty one years.

Fourthly, I do give and bequest to my son Alexander C. Wallace (born Feb 25, 1802) and to his heirs and executor administrator … the sum of three hundred dollars to be paid in one year after my decease.
 
 
 
 

Fifthly, I do give and bequest to my son David Wallace –born Nov 17, 1801 ( great-great-great grandfather of Brandon Wallace, Lewis Wallace and LeRoy Wallace), and to his heirs and executor administrators … the sum of three hundred dollars to be paid within two years after my decease.

Sixthly, I do give and bequest to my son John Wallace and to his heirs and executor administrators … the sum of three hundred dollars to be paid within three years after my decease.

Seventhly, I do give and bequest to my daughter Sally Ann Merrils and to her heirs and executor administrator …the sum of three hundred dollars to be paid within four years after my decease.

Eighthly, I do give and bequest to my daughter Elizabeth Strikir (wife of William Strikir)

and to her heirs and executor administrator …the sum of three hundred dollars to be paid within five years after my decease.

Ninthly, I do give and bequest to my daughter Ellen Thompson (wife of Phil E. Thompson) and to her heirs and executor administrator …the sum of three hundred dollars to be paid within five years after my decease.

Tenth, I do give and bequest to my daughter Sara Carpenter (wife of Robert Carpenter of Chemong ) and to her heirs and executor administrator …the sum of three hundred dollars to be paid within five years after my decease.

Eleventh, I do give and bequest to my daughter Nancy Wallace and to her heirs and executor administrator …the sum of three hundred dollars to be paid within five years after my decease.

Twelfth, I do give and bequest to my grandson; Emanuel Stevens ( only child of Margaret Wallace Stevens) the son of my deceased daughter Margaret provided he shall live to the age of twenty one years the sum of thirty dollars to be paid to him or his .. where he shall have arrived at the age of twenty one years. But in the event of this death before that period then the sum given and bequeathed to him shall be equally divided amongst my sons and daughters …before named and paid to them or their respective heirs at the period above mentioned.

Thirteen, It is my will and desire and I do so will order and direct that my beloved wife Anna ( Campbell) shall continue to reside with by said son Moses and that she be provided for and supplied by him with all needful provisions and all things … for her comfortable maintenance and support during her natural life to be accepted by her in case she shall elect to do so in lieu of her right of ….. said farm.

Fourteenth: All the … and remainder of my estate real or personal I do hereby give …and bequeath to my said son Moses W. Wallace and to his heir and …forever.. I do hereby …..appoint my said son Moses W. Wallace and my friend George Landes Executors of this my last will and testament and hereby revoking all other or former wills by me…..
 
 

In witness where of I have here unto set my hand and offered my seal this tenth day of November in the year of our Lord One Thousand Eight Hundred and Forty Three.

Sealed, published, and declared by the above named Moses Wallace and acknowledged and declared by heir to be his Last Will and Testament in the presence of the subscriber who have placed our names as witnesses…in his presence and at his request .. the presence of each other.

Statement from Moses W. Wallace ( son of Moses Wallace)

Subscribed from the Chemung Records (page 377)- New York State on Dec 17, 1843

( after Moses Wallace's death)

State of New York, Chemung County

Moses W. Wallace being duly sworn .. and says that he is one of the executor named in the Last Will and Testament of Moses Wallace deceased herin Court produced that said Moses Wallace died on the 28th day of November 1843 and at the time of his death, resided in the town of Chemung in the County of Chemung that the said will relates to both real and personal estate. That the said deceased left a widow Anna (Campbell) Wallace and the following children and heirs at law by:

Alexander Wallace-who resides at Williamburgh in Northhampton County, Pennsylvania

David Wallace- who resides at Richmond, Northhampton County, Pennsylvania.

John Wallace- who reside at Ridgebury, Bradford County, Pennsylvania

Sally Ann- wife of William Meriels who resides at Richmond, Northhampton County, Pa

Elizabeth – wife of William Striker who resides at Southpart Chemung County, NY.

Ellen – wife of Phil E. Thompson who resides at Payton Adams County, Illinois

Jane- wife of Robert Carpenter who resides at Chemung County, NY

Nancy Wallace of Chemung

Moses W. Wallace- executor as fore said

Emanuel Stevens; a grandson and only child of Margaret Wallace, a deceased daughter of the said and resides at Wilkes-Barre, Luzerne County, Pa is a minor Moses Wallace.(?)

Christian Wallace and three other children whose names are unknown to this …and all of whom are minors and grand children of the said … and children of Joseph Wallace deceased.

Moses resides in Chemung asforesaid and the other four of said grand children reside at Richmond, Northhampton County, Pa,
